01Accepting these terms

By visiting or using kovalya.com you accept these Terms of Use. If you do not accept them, please do not use the site.

Buying something is governed by our Terms of Sale; how we handle your information is governed by our Privacy Policy. Together with our Legal Notice, these four documents make up the agreement between us.

02Who runs this site

kovalya.com is published and operated by Kovalya, 4174 Granville St, Hubbards, NS B3K 5M1, Canada.

The store is hosted by Shopify International Limited, Dublin, Ireland. Contact us at any time at contact@kovalya.com — we answer within 24 business hours.

03Who may use the site

You may use the site if you are of the age of majority in your province or territory of residence. If you are a minor, you must have permission from a parent or guardian, and they remain responsible for your use of the site.

We sell and deliver in Canada only. You are welcome to browse from anywhere, but we cannot ship outside Canada.

04Your account

You can order without creating an account. If you do create one, keep your login details to yourself: you are responsible for anything done through your account.

Tell us straight away at contact@kovalya.com if you think someone else has access to it. We may suspend or close an account that is being used in breach of these terms.

05How you may and may not use the site

You may browse the site, place orders and use the features we make available, for your own personal use. We ask you to stay courteous and act in good faith towards other users and towards us.

You may not:

• use the site for anything unlawful, or to encourage anyone else to do so;
• copy, scrape, resell or exploit any part of the site without our written permission;
• upload viruses or any code designed to disrupt the site;
• try to gain unauthorised access to the site, to another user's account, or to our systems;
• interfere with the security features of the site;
• harass, abuse, defame or discriminate against anyone;
• submit false or misleading information, use a false email address, or pretend to be someone else.

We may refuse service, and we may take action against any attempted fraudulent purchase or any purchase made with a stolen, forged or unauthorised credit card.

06Product information, images and errors

We describe our products in as much detail as we can. Even so, photographs are illustrative: colours and finishes can look different depending on your screen, the lighting and the camera angle.

We do our best to keep prices, availability and descriptions accurate and up to date, but we cannot guarantee that everything on the site is free of error at every moment. If an obvious error affects an order you have placed, we will tell you and give you the choice between confirming at the corrected price or cancelling for a full refund.

07Bedding and jewelry — what to check before ordering

Both product families we sell have their own rules. They are set out in full in our Shipping & Returns page and our Refund Policy. In short:

You get 30 nights to try it from delivery, refunded with no reason needed. For hygiene reasons, bedding returned visibly soiled, stained, torn or damaged by abnormal use cannot be taken back.

08Reviews and content you post

If you send us ideas, suggestions, reviews or other material ("feedback"), whether we asked for it or not, you grant us the right, at any time and without restriction, to edit, copy, publish, distribute, translate and use it on any medium.

We are not obliged to keep feedback confidential, to pay for it, or to reply to it. We may monitor, edit or remove content we consider, at our sole discretion, unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable.

You agree that your content does not infringe anyone else's rights, and you remain responsible for what you post and for its accuracy.

09Intellectual property

Everything on the site — its structure, text, images, graphics, logo, icons, sound and software — belongs to Kovalya or is used with the owner's permission, and is protected by copyright and trademark law.

You may not reproduce, display, modify, publish, adapt or exploit any part of it, by any means, without our prior written permission, which you can request at contact@kovalya.com. Any link to the site must be removed on request.

10Links, third-party apps and social features

The site may link to other sites, and may embed third-party features such as social network share or like buttons. We cannot check everything on those services and accept no liability for their content.

Those networks may be able to recognise you even if you did not click anything, if you were signed in to them at the same time. We have no control over what they do with that. Please read their own privacy policies.

11Availability of the site

The site is in principle available 24 hours a day, 7 days a week, except during scheduled or unscheduled interruptions for maintenance or in cases beyond our control.

We do our best to restore access quickly and to give notice of planned work. This is an obligation of means, not of result: we cannot be held liable for damage resulting from the site being unavailable.

12Limitation of liability

You use the site at your own risk. We cannot be held liable for:

• indirect damage, in particular loss of profit, loss of custom or loss of data, arising from using the site or from being unable to use it;
• a malfunction, an unavailability, or the misuse or misconfiguration of your own device;
• the content of advertisements, links or external sources reachable from the site.

13Privacy and cookies

How we collect, use, share and protect your personal information — including the full list of cookies, how long we keep things, who our service providers are and how to exercise your rights — is set out in our Privacy Policy.

In short: we never sell your information, you can withdraw your consent at any time, and we answer every privacy request within thirty (30) days at the most. We follow Canadian privacy law (PIPEDA, and Quebec's Law 25).

14Changes to these terms

We may update these terms at any time by publishing a new version on this page. The version in force is the one published here on the day you use the site. The date at the top tells you when it last changed. We review this page at least every three (3) years.

If any provision is found unlawful, void or unenforceable, it is treated as severable and the rest stays in force.

15Governing law and disputes

Kovalya sells to customers in Canada. These terms are governed by the applicable laws of Canada and of the province or territory where you live, and the courts of the consumer's place of residence have jurisdiction.

If something goes wrong, please write to contact@kovalya.com first — most things are settled in one exchange. If we cannot find a solution, you can contact the consumer protection body of your province, such as the Office de la protection du consommateur in Quebec, or the Office of Consumer Affairs of the Government of Canada. That does not stop you from taking the matter to the competent courts.
