Terms of Service
Welcome to kovalya.com (the "Site"), operated under the brand Kovalya ("we", "us"). These Terms of Service govern access to the Site and any order placed on it. By browsing the Site or placing an order, you accept these terms in full. If you don't accept them, please don't use the Site.
1. Eligibility
You must be at least 18 and legally able to enter a contract. By ordering, you confirm the information you provide is accurate and complete.
2. The Site and products
We present our products as accurately as we can. Photos and descriptions are indicative: slight variations in colour, finish or dimensions may occur and are not defects.
Products are offered subject to availability. We may change, remove or suspend a product at any time without affecting orders already confirmed.
3. Prices
Prices are shown in US dollars (USD) and/or pounds sterling (GBP) depending on your market. Where UK VAT applies to low-value consignments (£135 or less), it is shown and charged at checkout. Otherwise, prices do not include customs duties, import taxes, sales tax or clearance fees, which remain your responsibility (see section 8).
Any shipping fees are shown before you complete checkout. We may change prices at any time; your order is billed at the price in effect when you place it. If a price is obviously wrong, we may cancel the order and refund you in full.
4. Orders
The sale contract is formed when we send your order confirmation email. We may refuse or cancel any order that appears abnormal or fraudulent, or that comes from a customer with an unresolved payment dispute.
5. Payment
Payment is due at the time of order. Transactions are handled by third-party providers certified to PCI-DSS; we never have access to your full card details and don't store them. Orders are processed only after payment is authorised.
6. Shipping and delivery
Shipping zones, times and costs are set out in our Shipping Policy, which forms part of these terms. Delivery times are indicative. Risk passes to you when the parcel is handed over at the address provided.
7. Returns and refunds
Cancellation, withdrawal and refund terms are set out in our Refund Policy.
- UK customers: 14-day cancellation right under the Consumer Contracts Regulations 2013, extended to 30 days by us.
- EU customers: 14-day withdrawal right under Directive 2011/83/EU, extended to 30 days.
- US and other customers: returns accepted within 30 days of delivery under the Refund Policy.
8. Customs, duties and import taxes
You are the importer of the products and responsible for your country's import rules.
United States: the "de minimis" exemption (under $800) has been suspended since 29 August 2025 and made indefinite since. Every shipment is subject to a customs declaration and applicable duties and taxes. Unless stated otherwise at checkout, these are payable by you and collected by the carrier or customs.
United Kingdom: for consignments where UK VAT applies (£135 or less sold to consumers), VAT is charged at checkout under HMRC rules. For higher-value consignments, import VAT and any duty may be payable on delivery unless prepaid duties (DDP) are offered.
European Union: applicable VAT and, where relevant, import duties may apply depending on order value and destination.
9. Warranties and statutory rights
Nothing in these terms affects your non-waivable statutory rights as a consumer.
UK customers: goods must be of satisfactory quality, fit for purpose and as described under the Consumer Rights Act 2015.
EU customers: you benefit from the 24-month legal guarantee of conformity under Directive (EU) 2019/771.
Other jurisdictions: products come with the statutory guarantees of your country of residence. To the extent permitted by law and without prejudice to mandatory statutory guarantees, products are otherwise provided "as is". Warranty claims: contact@kovalya.com, with your order number and photos.
10. Acceptable use
You agree not to: use the Site for unlawful or fraudulent purposes; attempt to access our systems without authorisation; introduce malicious code; scrape or harvest our data with bots; reproduce the Site to build a competing service; or impersonate anyone. Any breach may lead to immediate suspension of your access and, where appropriate, legal action.
11. Intellectual property
All elements of the Site — text, logos, trademarks, imagery, code — are our exclusive property or that of our licensors, protected by intellectual property law. The Kovalya name and logo may not be used without our written consent. No order transfers any rights to you.
12. Customer-generated content
By posting a review, comment or photo, you confirm you own the rights to it and grant us a free, non-exclusive, worldwide licence to use it across our channels. We may moderate or remove, without notice, any content that is unlawful, defamatory, abusive or contrary to these terms.
13. Liability
To the extent permitted by law, our total liability for any order is capped at the amount actually paid for that order. We are not liable for indirect losses (loss of profit, loss of opportunity, loss of data). These limits don't apply in cases of fraud, gross negligence, death or personal injury, or where the law prohibits limitation.
14. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control: natural disaster, epidemic, conflict, strike, transport disruption, customs disruption, cyberattack or a decision of a public authority.

16. Complaints and disputes
Complaints: contact@kovalya.com. We respond within 5 business days and prioritise an amicable resolution. EU customers may use the European Commission's online dispute resolution platform: ec.europa.eu/consumers/odr.
17. Governing law
These terms are governed by Belgian law, without depriving you of the protection of the mandatory consumer-law provisions of your country of residence. Failing an amicable solution, the courts of the Brussels judicial district have jurisdiction, subject to the mandatory rules protecting consumers.
18. Changes
We may update these terms at any time. The version that applies is the one in effect when you order or visit. Please check this page from time to time.
